ATA Carnet Specifics

The customs procedure of internal transit from border Customs offices to internal Customs offices, involving the use of blue transit sheets, applies only if the Customs office at the place of arrival (located at the border) is not authorized to proceed the customs clearance of the following categories of goods:

  1. Only the following specialized customs offices are authorized to carry out the customs clearance for jewelry, antiques and cultural valuables under cover of an ATA Carnet:
    • Specialized Customs point (12, Smolnaya street, Moscow);
    • Malahit Customs point (27, Gogol Street, Ekaterinburg, Sverdlovsk Region, 620057);
    • North-West Excise Customs point (40 «а», Kulturi avenue, Saint-Petersburg);
    • Kaliningrad Excise Customs point (16, Druzhbi street, Bagrationovsk, Kaliningrad Region).

Once cleared by the specialized Customs offices, the goods can then circulate freely within the entire territory of the Russian Federation.

  1. Goods requiring special authorization or license to be temporarily admitted (e. g. dual-use goods).
  2. ATA Carnets must imperatively contain two sets of blue transit sheets.

For transit between Ukraine and Russia, the following ports at the border crossing are authorized to process ATA Carnets:
Dolzhanskyy (UA) – Novo-Shakhtinsk (RU)
Krasna Talivka (UA) – Voloshino (RU)
Hoptivka (UA) – Nekhoteyevka (RU)
Bachivsk (UA) – Troebortneye (RU)

Ukraine Customs require obligatory documents to be presented with Carnets at the time of customs clearance. This rule is applicable to all intended use.

Documents require for customs clearance are:

  • ATA Carnet
  • Contract between foreign and Ukrainian counterparts mentioning the place, date, and conditions under which the following presentation of samples will take place (or Invitation Letter)
  • CMR (or other transportation document)

Without these documents the ATA Carnet will not be accepted for customs clearance. When a Holder doesn’t present these documents, Ukraine customs may ask the Holder to leave the goods at customs.

Due to the recent situation in Crimea ATA Carnet privileges are currently suspended for entry into Crimea and Sevastopol. Our understanding is that ATA Carnets are welcome everywhere else in Ukraine.

Please be aware that if you are unable to re-export from the Ukraine prior to the final date of re-export (Box 2 of the white importation counterfoil) or the expiration date of your ATA Carnet Ukraine Customs will charge a late re-exportation penalty at the time the ATA Carnet and goods are presented for re-exportation. This is in addition to any claims filed against the ATA Carnet. The penalty amount is as follows:

  1. UAH 850 (approx. €25) – Less than 3 days past the stipulated date of re-exportation
  2. UAH 5,100 (€150)  — second offense (less 3 days on a different Carnet) of the same Holder in the same year
  3. UAH 5,100 (€150)  — between 4 to 10 days
  4. UAH 17,100 (€500)  — between 11-20 days
  5. UAH 34,000 (€1,000)  – more than 20 days

Payment method:

  1. Ukraine customs officer will draw up a violation notice to the person who submitted the ATA Carnet for entry.
  2. The amount of penalty as well as custom’s bank info will be indicated on the notice.
  3. Payment to customs will be made to the bank. Once paid, Ukraine customs will issue a receipt to the payor.
  4. Cash payment is not acceptable.
  5. Penalty notice may be issued after Carnet goods departed.

Extension of the ATA Carnet is possible, the Holder or Authorized Representative must contact Ukrainian customs administration for approval prior to the “Final Date of Re-exportation noted in Box 2 of the white counterfoil or the expiry Date of the Carnet.
